General Terms and Conditions (GTC)

§ 1 Scope

These General Terms and Conditions (GTC) apply to all deliveries from PIO O'KAN Collection GmbH (hereinafter PIO O'KAN) to consumers.

These Terms and Conditions of Sale apply exclusively. We do not accept any deviating or conflicting terms and conditions unless we have expressly agreed to them in writing.

A consumer is any natural person who concludes a legal transaction for a purpose that cannot be predominantly attributed to his or her commercial or independent professional activity.

§ 2 Contracting parties

The purchase contract is concluded with PIO O'KAN Collection GmbH, Königsallee 27, 40212 Düsseldorf, Commercial Register: District Court of Düsseldorf, HRB 78023.

§ 3 Conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but merely an invitation to order.

By clicking the [Buy/order for a fee] button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

§ 4 Right of withdrawal

If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

If you, as a consumer, exercise your right of withdrawal in accordance with section 4.1, you will have to bear the regular costs of return.

Furthermore, the following provisions apply to the right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last goods. To exercise your right of cancellation, you must notify us

by means of a clear statement (e.g., a letter sent by post, email, or telephone) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

Consequences of revocation

If you cancel this contract in its entirety, we will refund all payments we have received from you, including shipping costs, promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back undamaged.

You must return the goods promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract to:

to return or hand over.

The deadline is met if you send the goods before the expiry of the fourteen-day period. The buyer bears the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their quality, properties, and functioning.

§ 5 Prices and shipping costs

The prices stated on the product pages include statutory VAT and other price components.

In addition to the stated prices, we charge a shipping fee depending on the recipient country and shipping service. These shipping costs will be clearly stated on the product pages, in the shopping cart system, and on the order page.

§ 6 Delivery / Shipping

Delivery is only within Germany with UPS.

No shipping to PO boxes or parcel stations.

After receipt of payment, the goods are usually ready for dispatch within 2-3 business days. Any possible delivery times will be indicated on the respective product page.

§ 7 Payment

Payment is made in advance.

We accept the following payment methods in advance: Credit card (Visa, Mastercard, Maestro, American Express), PayPal, Amazon Pay

All payments and credits are processed in EURO (€). For credits to foreign accounts, the recipient is responsible for all bank and transaction fees, if applicable.

§ 8 Returns

You can return ordered goods to us within 14 days of receipt or return them to our store. The customer will bear the return shipping costs.

Goods supplied by us may only be used for inspection purposes – for example, as is customary in a store for fitting – and must be returned using the enclosed return slip.

Only items with the safety tag and original label attached can be returned. If the safety tag has been removed or damaged for any reason, returns are not possible.

To return your order, please fill out the enclosed return slip and enclose it with your return. If your order is not accompanied by a return slip, you can obtain one upon request from our customer service.

Please retain your receipt until you receive confirmation from us that your return has been received. This receipt documents the return date and the receipt number of your return.

Once your return is approved, you'll receive an email confirming that the refund will be credited to your account within 14 days. You'll receive the refund using the same method you used to pay for your purchase.

§ 9 Retention of title

The goods remain our property until full payment has been made.

§ 10 Dispute resolution

The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
